The use of AI and ADM can enhance efficiency in terms of the number of cases, particularly standard cases, that will be able to be decided by courts, but also from the perspective of the amount of information about the case that will be available to judges, law clerks and court officials when deciding a specific case.
At the same time, the use of AI and ADM by justice systems raises questions from the perspective of the meaning of an effective judicial remedy and their article 47 CFREU, on the existence of rights, on their scope, and on the mechanisms that we have to be adopted in order to ensure that the use of those systems comply with individual fundamental rights.
