1) PHASE 1 - MARCH 2025 - Design and structure of the insolvency proceeding. Test up to the admission order
a) Design of the structure of the AI system
b) Test the performance of the system with the first anonymized files
c) Extract the information and generate a case summary report
d) Generate alarms for lack of mandatory documentation – generation of regulatory proceedings for lack of procedural documentation
e) When compliant with legal requirements, generate a proposal of order of admission of the case to the insolvency proceeding for natural persons with no assets
2) PHASE 2 - JUNE 2025 - Complete the structure of the insolvency prooceeding and generate the order concluding the proceeding and establishing the debt waiver
The data protection concerns basically deal with the requirement to anonymize every single file contain in each of the 3000 court cases and the assurance of the lack of treatment of the data obtained to learn from data subjects.
The Catalan government requires us to contract a third-party company to anonymized the documents included in each of the 3000 court cases so that treatment takes place on anonymized data.
As of now, anonymization technology shows limited effectivness when dealing with heterogeneous document types, document structures and formats.
a) Calculate whether the debtor has assets or lack of assets
b) Present and display the income/debt segments to the judge based on the inventory of creditors, the income of the debtor and the minimum untouchable.
c) Classify credits depending on whether they are waivable or non waivable under the consolidated text of the bankruptcy law.
d) Generate the notification orders with the templates we have available
e) Generate the order concluding the procedure
f) Generate the order of debt waiver
g) Empirical study of the 3000 anonymized case files– starting December 2025
3) PHASE 3 - FALL 2025 - Validate the proof of concept with real cases
We have recently agreed with the Catalan government to test the system with real cases in the fall. The justice department of the Catalan government will establish this the security requirements cases filed in real time that will be processed by commercial courts in Barcelona so the regular and solvency proceedings while we will be able to test the system through introducing the same information and seeing what are the results that were obtaining.
They will host the cases in their servers and run the code of the proof of concept in their servers. We will be able to access and observe the results as well as have access to the resolutions adopted by the Barcelona commercial courts on the same cases.
As of now we still need to define the amount of cases, the length of time we will be conducting this test but assuming we will have enough volume to observe and compare the outcomes of the cases under both systems – ordinary courts decisions and the AI judicial assistant- we intend to
(1) test the system for the errors it may have,
(2) observe whether the system helps judges, law clerks, and court officials in saving time or instead, having to check the system will take more time than they would otherwise, and
(3) analyze whether the AI system provide more and better information to the judge, law clerk or court official than the one he would use when deciding without the AI judicial assistant.
